Acceptable Use Policy (AUP)

This AUP governs the use of MIXMAXSPACE Hosting web hosting service. Violation of this AUP may result in suspension or termination of your service. In the event of a dispute between you and MIXMAXSPACE Hosting, regarding the interpretation of this AUP, MIXMAXSPACE Hosting’s interpretation, in its reasonable commercial judgment, shall govern. This AUP is incorporated by this reference into each Customer's service agreement. MIXMAXSPACE Hosting reserves the right to amend this AUP from time to time, and a Customer's use of the Services after changes to the AUP are posted on MIXMAXSPACE Hosting web site http://mixmaxspace.com/pages/home/aup.php will constitute the Customer's acceptance of any such amendments. Offensive Content

You may not publish or transmit via MIXMAXSPACE Hosting’s service any content that MIXMAXSPACE Hosting reasonably believes:

• constitutes child pornography;
• is excessively violent, incites violence, threatens violence, or contains harassing content or hate speech;
• is unfair or deceptive under the consumer protection laws of any jurisdiction, including chain letters and pyramid schemes;
• is defamatory or violates a person’s privacy;
• creates a risk to a person’s safety or health, creates a risk to public safety or health, compromises national security, or interferes with a investigation by law enforcement;
• improperly exposes trade secrets or other confidential or proprietary information of another person;
• is intended to assist others in defeating technical copyright protections;
• clearly infringes on another person’s trade or service mark, patent, or other property right;
• promotes illegal drugs, violates export control laws, relates to illegal gambling, or illegal arms trafficking;
• is otherwise illegal or solicits conduct that is illegal under laws applicable to you or to MIXMAXSPACE Hosting; or
• is otherwise malicious, fraudulent, or may result in retaliation against MIXMAXSPACE Hosting by offended viewers.

Content “published or transmitted” via MIXMAXSPACE Hosting’s service includes Web content, e-mail, bulletin board postings, chat, and any other type of posting or transmission that relies on any Internet service provided by MIXMAXSPACE Hosting.

Unacceptable Usage

Examples of unacceptable content include, but are not limited to:

• Copyrighted media, without authority to distribute or display
• Unlicensed applications
• Cracking programs or key generators
• Child pornography or kidnapping material
• Fraudulent activity, phishing, pyramid schemes, chain letters, forgery, or impersonation
• Terrorist propaganda, racist material, or bomb/weapon instructions
• Virus, Spyware, Malware, or other infectious material
• Material protected by trade secret or other statute

Additionally, MIXMAXSPACE Hosting prohibits:

• IRC and associated programs (including psybnc, "bots", etc...)
• Scripts commonly used for abuse, attacks, or flooding
• Threatening, harrassing, or obscene content
• Any proxies which do not require authentication (including open mail proxies, unprotected anonymous web surfing proxies, etc...)

Legal adult content is permitted on all of our servers. The viewing/downloading or possession of such information/data by MIXMAXSPACE Hosting clientele is not governed by MIXMAXSPACE Hosting policy, and is at your own discretion/free-will, and may be governed by your state/federal government.

Links to unacceptable content, as defined above, are also prohibited.

Security

You must take reasonable security precautions. You must protect the confidentiality of your password, and you should change your password periodically. Outdated scripts which posse a security risk can and will be disabled without prior notice. All clients are responsible for any installed script and must insure they are continuously updated with the latest version.

Bulk E-Mail

You must obtain MIXMAXSPACE Hosting’s advance approval for any bulk e-mail, which will not be given unless you are able to demonstrate all of the following to MIXMAXSPACE Hosting’s reasonable satisfaction:

• Your intended recipients have given their consent to receive e-mail via some affirmative means, such as an opt-in procedure;
• Your procedures for soliciting consent include reasonable means to ensure that the person giving consent is the owner of the e-mail address for which the consent is given;
• You retain evidence of the recipient’s consent in a form that may be promptly produced on request, and you honor recipient’s and MIXMAXSPACE Hosting’s requests to produce consent evidence within 24 hours of receipt of the request.
• The body of the e-mail must describe how the e-mail address was obtained, for example, “You opted in to receive this e-mail promotion from our Web site or from one of our partner sites,” and information on how to request evidence of the consent, for example, “If you would like to learn more about how we received your e-mail address please contact us at abuse@mixmaxspace.com;
• You have procedures in place that allow a recipient to easily revoke their consent – such as a link in the body of the e-mail, or instructions to reply with the word “Remove” in the subject line. Revocations of consent are honored within 24 hours, and you notify recipients that their revocation of their consent will be honored in 24 hours;
• You must post an abuse@mixmaxspace.com e-mail address on the first page of any Web site associated with the e-mail, you must register that address at abuse.net, and you must promptly respond to messages sent to that address;
• You must have a Privacy Policy posted for each domain associated with the mailing;
• You have the means to track anonymous complaints;
• You may not obscure the source of your e-mail in any manner. Your e-mail must include the recipients e-mail address in the body of the message or in the “TO” line of the e-mail; and
• Relaying mail services through MIXMAXSPACE Hosting's servers is strictly prohibited. All mail must be sent via SMTP for tracking purposes and a maximum of 250 e-mails are allowed per hour per account; and
• You otherwise comply with the CAN SPAM Act and other applicable law.

These policies apply to messages sent using your MIXMAXSPACE Hosting service, or to messages sent from any network by you or any person on your behalf that directly or indirectly refer the recipient to a site hosted via your MIXMAXSPACE Hosting service. In addition, you may not use a third party e-mail service that does not practice similar procedures for all its customers.
MIXMAXSPACE Hosting may test and otherwise monitor your compliance with its requirements, including requesting opt-in information from a random sample of your list at any time.

Unsolicited E-Mail

You may not send any unsolicited e-mail, either in bulk or individually, to any person who has indicated that they do not wish to receive it.
You must comply with the rules of any other network you access or participate in using your MIXMAXSPACE Hosting’s services.
Violators will be assessed a minimum fine of $500 and will face immediate suspension.

Spam Advertising E-Mail

You may not post any unsolicited e-mail to any newsgroups, online forums, or interactive web sites using your MIXMAXSPACE Hosting’s services such as e-mail addresses or directing people to your MIXMAXSPACE Hosting’s web site account.
You must comply with the rules of any other network you access or participate in using your MIXMAXSPACE Hosting’s services.

Other

You must have valid and current information on file with your domain name registrar for any domain hosted on the MIXMAXSPACE Hosting network. MIXMAXSPACE Hosting is to be used for domain hosting only. After your account has been activated you have 7 days to properly point your domain using the nameservers provided to you in your welcome e-mail. Failure to do so will result in termination and a refund is voided.

Back Up Copy

Customer agrees to maintain a current copy of all content hosted by MIXMAXSPACE Hosting notwithstanding any agreement by MIXMAXSPACE Hosting to provide back up services. MIXMAXSPACE Hosting is not held responsible for any data lose due to negligence which resulted from clients actions.

Internet Abuse

You may not engage in illegal, abusive, or irresponsible behavior, including:

• Unauthorized access to or use of data, systems or networks, including any attempt to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures (including those belonging to MIXMAXSPACE Hosting and its customers) without express authorization of the owner of the system or network;
• monitoring data or traffic on any network or system without the authorization of the owner of the system or network;
• Interference with service to any user, host or network including, without limitation, mail bombing, flooding, deliberate attempts to overload a system and broadcast attacks;
• Use of an Internet account or computer without the owner’s authorization, including, but not limited to Internet scanning (tricking other people into releasing their passwords), password robbery, security hole scanning, and port scanning;
• Forging of any TCP-IP packet header or any part of the header information in an e-mail or a newsgroup posting; or
• Any conduct that is likely to result in retaliation against the MIXMAXSPACE Hosting’s network.
• Use of MIXMAXSPACE Hosting’s network in a way that unreasonably interferes with MIXMAXSPACE Hosting’s other customers use of the network

Newsgroup, Chat Forums, Other Networks

You must comply with the rules and conventions for postings to any bulletin board, chat group or other forum in which you participate, such as IRC and USENET groups including their rules for content and commercial postings. These groups usually prohibit the posting of off-topic commercial messages, or mass postings to multiple forums.

All forums based boards must enable SMTP for all communications from clients board to their members. Forums based boards are strictly prohibited to send mail by relaying e-mail through our servers.

Disclaimer

MIXMAXSPACE Hosting is under no duty, and does not by this AUP undertake a duty, to monitor or police our customers’ activities and disclaims any responsibility for any misuse of the MIXMAXSPACE Hosting network.

Acceptable Use Policy (AUP)

Acceptable Use Policy untuk selanjutnya disebut sebagai AUP ini terikat dengan Term of Service Agreement yang terintegrasi dalam kesepakan Pengguna Layanan dengan MixMaxSpace Hosting sebagai Penyedia Layanan. MixMaxSpace Hosting berhak untuk membatalkan dan tidak melanjutkan Layanan yang diberikan tanpa kewajiban apabila Pengguna Layanan melakukan pelanggaran terhadap AUP.

AUP ini merupakan daftar Penggunaan Layanan yang tidak diperbolehkan dan bersifat non ekslusif serta dapat ditambahkan atau dimodifikasi kapan saja dan berlaku efektif ketika dipublish melalui http://mixmaxspace.com/pages/home/aup.php.

Penggunaan Umum / General

Layanan yang disediakan oleh MixMaxSpace Hosting hanya untuk digunakan oleh kepentingan yang tidak melanggar hukum dan peraturan yang berlaku baik di Negara Kesatuan Republik Indonesia maupun di negara lain.

Penyimpanan, penyebaran, penampilan data yang tidak sesuai / melanggar hukum yang berlaku tidak diperbolehkan, hal ini termasuk namun tidak terbatas kepada;

• Material yang memiliki Copyright kecuali ditentukan berbeda oleh pemiliknya
• Material yang mengancam keamanan dan keselamatan pihak lain
• Material yang merupakan rahasia milik pihak yang dilindungi oleh hukum.

Penggunaan program yang menghabiskan Resource Server pada lingkungan shared termasuk Layanan Shared, Reseller Hosting dan VPS, termasuk namun tidak terbatas kepada;

• Melakukan query database secara massal dan intensif
• Menyediakan fasilitas hotlinking dan menyedot traffic berlebihan sehingga menuntut resource tinggi
• Menggunakan program yang tidak atau belum sempurna dan dapat secara teknis membuat proses looping

Jenis Content

Contoh data / content yang dilarang;

• Software Bajakan
• MP3 Bajakan
• Fasilitas Spam
• Arsip Hacking
• Pornografi

Program Background

MixMaxSpace Hosting tidak mengijinkan program yang berjalan secara background termasuk Bot dan Software - software IRC, pengecualian diberikan per kasus dan kemungkinan akan ada biaya tambahan terkait dengan hal tersebut.

Upload Service

Untuk keperluan upload service seperti rapidshare dan lain-lain, dianjurkan user berada pada lingkungan dedicated. Karena layanan upload sangat memakan resources yang seharusnya dibagi kepada pengguna server yang lain.

Script

Anda boleh menggunakan script pada layanan anda, namun kami melarang penggunaan script yang menghabiskan resource server dan karenanya akan mengganggu pelanggan lain. Script seperti ini diantaranya adalah Script Banner Exchange, Auction, CGI Forum.

SPAM

Anda tidak diperbolehkan menggunakan segala aspek yang terkait dengan layanan MixMaxSpace Hosting untuk kepentingan menyebarkan dan mengirimkan SPAM. MixMaxSpace Hosting berhak menon-aktifkan account anda ataupun domain anda apabila terjadi hal tersebut.

Domain

Domain yang didaftarkan melalui MixMaxSpace Hosting akan menggunakan registrar Public Domain Registry. Sehingga perjanjian registrasi domain yang diterapkan juga berlaku bagi pelanggan MixMaxSpace Hosting yang juga mendaftarkan domainnya.
